TV Remote – Smart Control (Android)

1. Who we are, and what you are agreeing to
The app TV Remote – Smart Control (package eu.utilitynest.remote.control.stick.universal.smart.tv) is provided by ASO Positive, s. r. o., registered at Rovniankova 11, 851 02 Bratislava, Slovakia, company ID (IČO) 57393630, VAT ID (IČ DPH) SK2122694486 ("we", "us"). By installing or using the app you agree to these terms. If you do not agree, please do not use the app. Our Privacy Policy forms part of these terms.
2. Who may use the app
You must be at least 13 years old, or older if the age of digital consent in your country is higher. If you are under the age of majority where you live, you may use the app only with the consent of a parent or guardian, who accepts these terms on your behalf.
3. What the app does — and what it does not
- The app turns your phone into a remote control for Roku TVs and streaming players, and for Android TV / Google TV devices, over your own Wi-Fi network.
- Your phone and your TV must be on the same local network. Without that, the app cannot work — this is a limitation of the protocols involved, not a fault we can fix.
- Available controls vary by device. The app only shows keys your specific device reports it supports. Volume and power, for example, work on Roku TVs but not on Roku sticks and players.
- Android TV devices require a one-time pairing step, in which you enter a code shown on your TV screen.
- The Cast screen does not perform any casting or screen mirroring itself. It opens your phone's own system mirroring settings and explains how to use them. Whether mirroring works is entirely up to your phone and your TV.
- We cannot guarantee that any particular TV model works, or keeps working. Manufacturers change their firmware and their protocols, and that can break compatibility at any time.

This app is an independent product and is not affiliated with, endorsed by, or sponsored by Roku, Inc. or Google LLC. It communicates with devices using Roku's publicly documented External Control Protocol and the Android TV remote protocol.
4. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own private purposes. You may not:
- copy, redistribute, resell, rent out or sublicense the app;
- reverse-engineer, decompile or disassemble it, except to the extent that applicable law expressly permits it;
- modify it, or create derivative works from it;
- use it to control devices you do not own and have no permission to use;
- use it for any unlawful purpose, or to interfere with any network or device.
The app, its source code, design and content remain our property or that of our licensors.
5. The free version and advertising
The free version of the app is funded by advertising: a banner at the bottom of some screens, and occasional full-screen ads shown between screens or after a TV connects successfully.
Ads are served by Google AdMob. Their content is selected by Google, not by us, and we neither endorse nor take responsibility for what is advertised or for anything you buy from an advertiser. How advertising data is handled — and how to control it — is described in our Privacy Policy.
6. Premium subscription
Premium is an auto-renewing subscription that unlocks:
- removal of all ads;
- the touchpad and keyboard typing on the TV;
- the app launcher;
- unlimited saved TVs (the free version keeps one);
- priority customer support.
How billing works
- The subscription is sold and processed by Google Play. Google is the seller and merchant of record; we do not process payments and never see your payment details.
- The price, currency, billing period and any free trial are shown to you on the purchase screen before you buy. Those values are read live from Google Play, so what you see is what Google will charge.
- The subscription renews automatically at the end of each billing period, at the then-current price, unless you cancel at least 24 hours before the period ends.
- If your offer includes a free trial, it converts into a paid subscription automatically unless you cancel before the trial ends. Any unused part of a trial is forfeited when you buy a subscription.
- You can view, change or cancel your subscription at any time in Google Play → Subscriptions, or at play.google.com/store/account/subscriptions. Cancelling stops future renewals; you keep Premium until the end of the period you have already paid for.
- Premium follows your Google account. On a new device, sign in with the same account and use Restore purchases in Settings.
- Refunds are handled by Google Play under Google's refund policy. We cannot issue refunds ourselves. This does not affect your statutory rights as a consumer.
- If we change the price, Google will notify you in advance and ask you to accept it. If you do not accept, your subscription simply ends at the close of the current period.
We may add to or adjust Premium features over time, but we will not remove a feature that is materially part of what you paid for during a period you have already paid for.
7. Right of withdrawal (consumers in the EU)
As a consumer you normally have 14 days to withdraw from a distance contract. Because a subscription gives you immediate access to digital content, by completing the purchase you expressly request that performance begins immediately and acknowledge that you thereby lose your right of withdrawal once performance has begun — Article 16(m) of Directive 2011/83/EU, implemented in Slovakia by § 7(6)(l) of Act No. 102/2014 Coll.
In practice, requests to cancel and to be refunded shortly after purchase are handled through Google Play's refund process, which is often more generous than the statutory minimum.
8. Availability and changes
The app is provided on an "as is" and "as available" basis. We may update it, change how it works, or discontinue features or the app itself. We do not promise that it will be uninterrupted, error-free, or compatible with every device — and, as noted in section 3, a TV manufacturer's own update can break compatibility without warning.
9. Disclaimer of warranties
To the maximum extent permitted by law, we exclude all implied warranties, including those of merchantability, fitness for a particular purpose and non-infringement. Nothing in this section limits the statutory rights you have as a consumer, which apply regardless of what these terms say.
10. Limitation of liability
To the extent permitted by law:
- we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or opportunity;
- we are not liable for anything that happens on your TV as a result of ordinary remote-control commands you send, nor for the acts of third parties including Google, Roku, advertisers, or your network provider;
- where liability cannot be excluded, our total liability is limited to the amount you paid us for the app in the twelve months before the event giving rise to the claim.
Nothing here excludes or limits our liability for death or personal injury caused by negligence, for fraud or wilful misconduct, or for anything else that cannot lawfully be excluded — in particular mandatory consumer protection law.
11. Third-party terms
Your use of the app is also subject to the Google Play Terms of Service, and to the terms of your TV manufacturer for the device you control. Where those terms conflict with ours in relation to a purchase made through Google Play, Google's terms prevail for that purchase.
12. Termination
You may stop using the app at any time by uninstalling it; cancel any active subscription in Google Play first, since uninstalling does not cancel it. We may suspend or end your licence if you materially breach these terms. Sections 4, 9, 10 and 14 survive termination.
13. Changes to these terms
We may update these terms. The "last updated" date at the top will change, and material changes affecting subscribers will be notified in the app or through Google Play. Continuing to use the app after a change means you accept the updated terms; if you do not accept them, stop using the app and cancel any subscription.
14. Governing law and disputes
These terms are governed by the law of the Slovak Republic, and the courts of the Slovak Republic have jurisdiction. If you are a consumer resident in another EU member state, this does not deprive you of the protection of mandatory provisions of your own country's law, and you may also bring proceedings in the courts of your own country of residence.
